North Carolina Decision in Sample v Jenkins

A three judge federal panel in the Eastern District of North Carolina in the case of Sample v Jenkins today unanimously denied the State of North Carolina's motion for a preliminary injunction to conduct the 2002 state legislative election under the precleared legislatively enacted 2001 plan, rather than an interim state court ordered plan that is still pending Section 5 preclearance at USDOJ.

Thus as of now the 2002 primary and election schedule in North Carolna is still in limbo.

The ruling was oral from the bench after oral arguments, there is no written decision yet.
